It may come as a surprise, but the federal government does not establish a single nationwide deadline for when final paychecks must be issued. In practice, final paycheck timing is generally governed by state law, which is why employers should review the rules that apply in the state where the employee worked.

 

Maryland Final Paycheck Rule
Maryland does have a specific final paycheck timing rule. In general, an employer must pay an employee all wages due for work performed before termination on or before the day the employee would have been paid if the employment had not ended. In many situations, that means the final paycheck is due by the next regular payday.

 

Because Maryland law ties final pay timing to the employee’s normal pay schedule, employers should make sure all final earnings are properly calculated and included in that payment.

 

Important Final Paycheck Considerations
Even when an employee is terminated, employers generally cannot withhold wages that have already been earned except where a lawful deduction applies. A final paycheck should include all compensation due through the employee’s last day worked. Maryland’s wage payment rules also require employers to provide written pay information and comply with notice requirements related to pay and leave benefits.

 

Employers should also review whether the employee is entitled to payment for accrued or unused vacation or PTO. In Maryland, an employer is not required to pay accrued leave at termination if the employer has a written policy limiting that payout, the employee was notified of the employer’s leave benefits, and the employee is not entitled to payment under the terms of that written policy. In other words, PTO payout at separation often depends on the employer’s written policy and whether that policy was properly communicated.

 

If severance is being paid, it is generally treated as taxable wages for withholding purposes. Employers should also remember that Maryland does impose state income tax withholding, and resident employees may also be subject to local income tax withholding. For that reason, final wages may be subject to Maryland withholding in addition to federal income tax withholding, Social Security, and Medicare. Maryland’s 2026 payroll materials also note that local withholding rates changed for some counties and that nonresident local tax is 2.25% in the state payroll guidance.
