Texas Final Paycheck Rule
Texas final paycheck timing depends on the reason for separation. If an employee is discharged, final wages are generally due within six calendar days after discharge. If an employee quits, resigns, retires, or otherwise leaves voluntarily, final wages are generally due on the next regularly scheduled payday.
Because Texas law sets different timing rules based on whether the separation is involuntary or voluntary, employers should determine the employee’s separation type before processing the final paycheck. Important Final Paycheck Considerations
