In practice, final paycheck timing is generally governed by state law, which is why employers should review the rules that apply in the state where the employee worked.

 

New York Final Paycheck Rule
New York does have specific final paycheck timing rules, but they depend on the type of worker. For most employees, final wages must be paid no later than the next regular payday following the end of employment. However, certain categories of workers, such as manual workers, may be subject to more frequent pay requirements under New York labor law.

 

Because New York law generally ties final pay timing to the employer’s regular payroll schedule, employers should make sure all final earnings are properly calculated and included in that payment.

 

Important Final Paycheck Considerations
Even when an employee is terminated, employers generally cannot withhold wages that have already been earned except where a lawful deduction applies. A final paycheck should include all compensation due through the employee’s last day worked, subject to applicable payroll deductions and withholding rules.

 

Employers should also review whether the employee is entitled to payment for accrued or unused vacation or PTO. In New York, payout of unused vacation or PTO at separation generally depends on the employer’s written policy, handbook provisions, employment agreement, or established practice. If an employer has a written policy stating that unused vacation will not be paid out, and that policy has been properly communicated, the employer may be able to enforce that policy under New York law.

 

If severance is being paid, it is generally treated as taxable wages for withholding purposes. Employers should also remember that New York does impose state income tax withholding, so final wages may be subject to New York State withholding in addition to federal income tax withholding, Social Security, and Medicare. In addition, some employees may also be subject to New York City or Yonkers local income taxes, which are not included in this estimator.
